Proposed regulations for mental health and substance use disorder parity were issued by the Departments of Labor (DOL), Health and Human Services (HHS), and the Treasury and published in the Federal Register on August 3. Along with the proposed regulations, the DOL and HHS simultaneously released their annual Mental Health Parity and Addiction Equity Act (MHPAEA) Comparative Analysis Report to Congress on mental health parity enforcement. This report provides an overview of results and specific scenarios encountered during the DOL and HHS’s audit activities and highlights corrective actions taken in order for plans to achieve parity compliance.
