New Program Provides Assistance with HIPAA, MHPA, NMHPA and WHCRA Compliance

On February 26, 2003 the Employee Benefit Security Administration (EBSA) — formerly the Pension and Welfare Benefits Administration — of the Department of Labor (DOL) announced a new compliance assistance program to help employers and health plans comply with the portability and nondiscrimination requirements of the Health Insurance Portability and Accountability Act of 1996 (HIPAA), as well as the Mental Health Parity Act (MHPA), the Newborns and Mothers' Health Protection Act (NMHPA) and the Women's Health and Cancer Rights Act (WHCRA). This new initiative, called "HIPAA Compliance Assistance Program" or "H-CAP," will consist of new publications intended to educate the public on the requirements of the law, a new section of the EBSA Web site dedicated to health law material, and compliance assistance workshops to be held around the country.

Plan sponsors should consider reviewing these documents to assure that their plans are being operated in compliance with federal health care laws. In particular, they may wish to answer the self-compliance tool and review any inconsistent responses with their legal counsel.
