PPACA and PPA – Where Are We Now and Where Are We Going?

The Patient Protection and Affordable Care Act (PPACA) required health and welfare plans to make many changes to plan design and administrative procedures over the past two years, and the impact of the law is just beginning. The various government agencies are releasing regulatory guidance on a monthly basis, with much more on the horizon. New issues that are emerging include:

  • Accountable Care Organizations (ACOs), set to launch in January 2012,
  • The new uniform Summary of Benefits and Coverage (SBC), tentatively due beginning March 23, 2012, and
  • Comparative Effectiveness Research (CER), already underway but due to receive additional private sector funding starting in 2012.

The most highly debated concept introduced in the PPACA – state health exchanges, including the concepts of employer free-rider penalties and individual mandates – are due to begin in 2014. These raise many concerns for multiemployer and government health and welfare plans.

Please join Darrin Owens, Senior Vice President and Benefits Consultant, as he explores these concepts and their potential effect on health and welfare plans. He will also discuss potential legal challenges to the law itself.

The Pension Protection Act of 2006 (PPA) has brought the terms of red, yellow and green zones into common discussion at Trustees’ meetings while also emphasizing long-term planning  by Pension Fund Trustees. Many of the provisions of this major law, the largest pension legislation since the passage of the Employee Retirement Income Security Act (ERISA) in 1974, are set to expire in 2014.

Please join Bob Ressegue, Vice President and Benefits Consultant, as he explores the impact PPA has had on defined benefit plans and the retirement income of individuals throughout the United States. He will also discuss what could be next on the legislative horizon.
